CGC Signature Series Authenticity Guarantee
1. APPLICATION OF GUARANTEE: This guarantee (the “CGC Signature Series Authenticity Guarantee”) is offered by CGC with respect to collectible items contained in a CGC protective holder bearing the words “CGC Signature Series” which are submitted to CGC for its “Authentication Review” service.
2. STATEMENT OF GUARANTEE: Subject to the limitations contained in this CGC Signature Series Authenticity Guarantee, CGC guarantees the authenticity of the signature inscribed on any collectible item contained in a CGC protective holder bearing the words “CGC Signature Series.” For purposes of this CGC Signature Series Authenticity Guarantee, a signature is considered authentic if it was inscribed by the named signatory in the presence of a CGC representative.
3. EXCLUSIVE REMEDY: In the event that a subsequent purchaser of a collectible item contained in a CGC protective holder bearing the words “CGC Signature Series” believes the signature not to be authentic, such person may submit the collectible item to CGC and purchase CGC’s Authentication Review services. If the signature is determined under such review by CGC not to be authentic (meaning, CGC determines that the signature was not inscribed by the named signatory in the presence of a CGC representative), then CGC shall pay to such subsequent purchaser an amount equal to the difference between (a) the lower of (i) the submitter’s purchase price for the collectible item and (ii) the fair market value of the collectible item if the signature were authentic; and (b) the current market value of the collectible item based upon what CGC believes, in its sole opinion, to be reliable current market information. CGC’s subjective determination of fair market value and current market value shall be binding on all parties.
4. LIMITATIONS: WARNING: The CGC Signature Series Authenticity Guarantee is limited. The CGC Signature Series Authenticity Guarantee applies solely to the signature, and not to the collectible item itself. The CGC Signature Series Authenticity Guarantee does not apply if the CGC holder has been damaged, unsealed, tampered with, removed or altered, and does not apply to clerical errors on the holder or label. The determination of what constitutes a clerical error is at the sole discretion of CGC. CGC does not utilize handwriting analysis or other similar methodologies to determine authenticity; authenticity is based solely on the presence of a CGC representative at the time the collectible item is signed.
5. IMPORTANT ADDITIONAL TERMS: THIS CGC SIGNATURE SERIES AUTHENTICITY GUARANTEE TAKES THE PLACE OF AND SUPERSEDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED AND WHETHER OF MERCHANTABILITY, FITNESS OR OTHERWISE. THE REMEDIES PROVIDED IN THIS CGC SIGNATURE SERIES AUTHENTICITY GUARANTEE ARE EXCLUSIVE. EXCEPT AS EXPRESSLY STATED IN THIS CGC SIGNATURE SERIES AUTHENTICITY GUARANTEE, ALL OTHER REMEDIES AGAINST CGC, INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, PUNITIVE, AND INCIDENTAL DAMAGES, ARE WAIVED.
